OUR BUILDING









As many of you know, in 2001, I bought a commercial building at 735
Route 25A in Kings Park to move the animal hospital to a larger, more
accessible location. The building was used as a rundown bar with a
crack house on the upper level. I closed down both when I purchased
the property. Neighbors came to congratulate me for doing what the
Town of Smithtown wouldn't; get rid of an eyesore and a danger to the
community.
I applied for the needed variances. After hitting numerous roadblocks,
The Town Planning Department now wants me to build a road next to
my property. Birch Road is a paper road on the west side of the
property. I have 100 feet of frontage on 25A, but the Town says I can't
exit my property on 25A. The Town said that zoning requires all new
buildings exit at least 75 feet from the intersection of 25A and any side
streets. But yet a new Dairy Barn opened on the corner of 25A and
Juniper Road with 2 exits, neither of which is 75 feet from the
intersection. Why does Dairy Barn, a large corporation, get
concessions that I cannot get? When this building was a bar, there
were approximately 10 parking spots in front of the building. Patrons
backed out enough to turn their cars and proceed onto 25A without
accidents occurring and yet I'm told that I can't exit onto 25A and will
have to construct a road. When I had gone in front of the Board for my
variance, I was asked if I would pave down to a side entrance since
the Board didn't want a driveway running parallel to the paper road. I
agreed to pave to a side entrance, but now the Planning Department
wants me to build a road beyond my property ending in a cul-de-sac
on property not owned by me or the Town.
After six years of trying to accommodate the Town, with no resolution
in sight, I will be forced to rent out the building as a bar, since I cannot
afford to keep it empty and I cannot afford to spend over $200,000 for a
road. The local community has asked me not to allow another bar to
open up there. They are afraid for their children, since school buses
stop nearby and children walk by the bar on their way home.
Maybe if enough residents complain to the Town Building Department,
360-7520, to finally rid our neighborhood of this eyesore and allow me
to renovate the building and move my well-established practice in, the
Town will finally listen to reason.
